Volunteer Sign-Up form and Release and Waiver of Liability"

​Important: Each volunteer must sign the “Release and Waiver of Liability” before working at FitZip.org/Earn-A-Bike Co-op.  Please complete this form and bring it with you before you begin work at the Earn-A-Bike Co-op. Read this waiver very carefully before you sign.
 
Waiver of Liability
 
This Waiver of Liability (the “Waiver”) executed and submitted on this in favor of FITZIP.ORG/EARN-A-BIKE CO-OP. OF SAN ANTONIO, a nonprofit corporation organized and existing under the laws of the State of Texas, USA, and its directors, officers, employees, and agents (collectively, “FitZip.org and Earn-A-Bike Co-op”).
 
I, the Rider/Volunteer, desires to particpate in events organized by FitZip.org/Earn-A-Bike Co-op. and engage in the activities related the programs.
 
I hereby freely and voluntarily, without duress, execute this Waiver under the following terms:
 
1. Waiver and Release. I, the Volunteer, release and forever discharge and hold harmless FitZip.org/Earn-A-Bike Co-op. and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my participation at FitZip.org/Earn-A-Bike Co-op related events.
I understand and acknowledge that this Waiver discharges FitZip.org/Earn-A-Bike Co-op. from any liability or claim that I, the participant, may have against FitZip.org/Earn-A-Bike Co-op. with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation on the FitZip.org/Earn-A-Bike Co-op. work site. I also understand that FitZip.org/Earn-A-Bike Co-op. does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
2. Insurance. I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of FitZip.org/Earn-A-Bike Co-op. beyond what may be offered freely by the representative of FitZip.org/Earn-A-Bike Co-op. in the event of such injury or medical expense.
3. Medical Treatment. I hereby release and forever discharge FitZip.org/Earn-A-Bike Co-op. from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with FitZip.org/Earn-A-Bike Co-op..
4. Assumption of the Risk. I understand that my time with FitZip.org/Earn-A-Bike Co-op. may include activities that may be hazardous to me, including, but not limited to, cycling activities, bicycle mechanics, loading and unloading of heavy equipment and materials, and local transportation to and from events and activities. I hereby expressly and specifically assume the risk of injury or harm in these activities and release FitZip.org/Earn-A-Bike Co-op. from all liability for injury, illness, death, or property damage resulting from the activities of my time with FitZip.org/Earn-A-Bike Co-op.
5. Photographic Release. I grant and convey unto FitZip.org/Earn-A-Bike Co-op. all right, title, and interest in any and all photographic images and video or audio recordings made by FitZip.org/Earn-A-Bike Co-op. during my work for FitZip.org/Earn-A-Bike Co-op., including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
6. Other. I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Texas in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of Texas. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
 
COVID-19 WAIVER

The World Health Organization has declared the novel Coronavirus (COVID-19) a worldwide pandemic. Due to its capacity to transmit from person-to-person through respiratory droplets, the government has set recommendations, guidelines, and some prohibitions which Earn A Bike adheres to comply.

In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:


--I am aware of the existence of the risk on my physical appearance to the event and my participation to the activity of Earn A Bike that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.

--I have not experienced symptoms that of fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 14 days.

--I have not, nor any member(s) of my household, traveled by sea or by air, internationally within the last 14 days.

--I did not, nor any member of my household, visit any area within the United States that was reported to be highly affected by COVID-19, in the last 30 days.

--I have not been, nor any member(s) of my household diagnosed to be infected of COVID-19 virus within the last 30 days.

Following the pronouncements above I hereby declare the following:

--I am fully and personally responsible for my own safety and actions while and during my participation and I recognize that I may be in any case be at risk of contracting COVID-19.

--With full knowledge of the risks involved, I hereby release, waive, discharge Earn A Bike, its board, employees, independent contractors, affiliates, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and cause of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

--I agree to indemnify, defend, and hold harmless Earn A Bike from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.


By signing below, I acknowledge that I have read the foregoing Liability Release Waiver and understand its contents; that I am at least eighteen (18) years old and fully competent to give my consent; That I have been sufficiently informed of the risks involved and give my voluntary consent in signing it as my own free act and deed with full intention to be bound by the same, and free from any inducement or representation.

This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted.

Volunteer Policies and Procedures

Purpose of Volunteer Policies

These policies are written to provide overall guidance and direction to staff and volunteers engaged in volunteer involvement and management efforts. These policies do not constitute, either implicitly or explicitly, a binding contractual or personnel agreement. Our agency reserves the exclusive right to change any of these policies at any time and to expect adherence to the changed policy. Changes to or exceptions from these policies may only be granted by the Volunteer Program Manager, and must be obtained in advance and in writing. Areas not specifically covered by these policies shall be determined by the Volunteer Program Manager.
Definition of 'Volunteer'A "volunteer" is anyone who, without compensation or expectation of compensation beyond reimbursement, performs a task at the direction of and on behalf of the agency. A "volunteer" must be officially accepted and enrolled by the agency prior to performance of the task. Unless specifically stated, volunteers shall not be considered as "employees" of the agency.

Volunteers Under 18
I
f you are under 18, please let at least one of your parents know you are going to volunteer with this Project. We strongly suggest that you give your parents the EAB URL so they can read through and provide their consent, and invite them to subscribe to our lists as well (see above). We also suggest you copy one or both of your parents on your weekly reports  when engaged in an assignment for us. Your parents are invited to call or e-mail the Volunteering Project Manager, with any questions or comments about our program.  info@earnabikecoop.org

Service at the Discretion of the Agency
Our agency accepts the service of all volunteers with the understanding that such service is at the sole discretion of the agency. Volunteers agree that the agency may at any time, for whatever reason, decide to terminate the volunteer's relationship with the agency. The volunteer may at any time, for whatever reason, decide to sever the volunteer's relationship with the agency. Notice of such a decision should be communicated as soon as possible to the volunteer¹s supervisor.

​Representing the Volunteering Project
Volunteers are asked to not contact organizations or individuals on behalf of the Volunteering Project unless they are given express written directions to do so by the Project Manager. Prior to any action or statement which might significantly affect or obligate the agency, volunteers should seek prior consultation and approval from appropriate staff. These actions may include, but are not limited to, public statements to the press, coalition or lobbying efforts with other organizations, or any agreements involving contractual or other financial obligations. Volunteers are authorized to act as representatives of the agency as specifically indicated within their job descriptions and only to the extent of such written specifications.

Confidentiality
Volunteers are responsible for maintaining the confidentiality of all proprietary or privileged information to which they are exposed while serving as a volunteer, whether this information involves a single staff, volunteer, client, or other person or involves overall agency business. Failure to maintain confidentiality may result in termination of the volunteer's relationship with the agency or other corrective action.

Screening/Reference Check
For some tasks, volunteers must submit samples of work and professional references. If such is required, it will be outlined in the task description.

Copyright/Ownership Issues
By signing up, you hereby grant non-exclusive permission to Earn A Bike Co-op for use of any materials produced for the Volunteering Project, including graphics materials, web page designs, narratives, research, compilations, instructional texts, etc., becomes the property of the Volunteering Project upon submission. Volunteers will receive credit on the Volunteering Project Web site for these and other contributions.

Orientation
Volunteers are expected to follow all directions provided to them in the orientation, received via e-mail after their submission of a completed volunteer application. This includes, but is not limited to, subscribing to the volunteer list serve, and following the reporting guidelines outlined in the orientation. By replying to this orientation with a request for an assignment, the volunteer is agreeing to both the policies set forth in this orientation email and the policies outlined in this volunteer handbook.

Contacting Other Volunteers
Occasionally, volunteers will need to contact other volunteers with regard to their activities with the Volunteering Project. We expect all such communications among volunteers to follow general netiquette guidelines. Other than email addresses, the Volunteering Project Manager will not share contact information about a volunteer with another volunteer without the express consent of all parties involved. We encourage volunteers to use common sense when communicating with other volunteers -- or anyone -- online. We suggest your following this rule: don't reveal anything about yourself online to someone that you would not feel comfortable revealing to a stranger you met on the street.

Inappropriate Communications
If at any point you receive any e-mail that you feel is inappropriate, for any reason, and you believe you have received it in conjunction with your involvement with the Virtual Volunteering Project, please forward the email and other details about the communication to the Virtual Volunteering Project Manager.

Online Safety
The safety of our volunteers is important to us. To that end, the Project will not release a volunteer's phone number, age or other personal information to anyone outside of our organization or to other volunteers without that volunteer's written permission to do so. We do list volunteers who have completed assignments for us, along with the city where they reside and their e-mail address, on a page on our Web site. We are happy to remove any or all of this information for a particular volunteer per that person's request. Please note that we do not make your e-mail address a "live link" on this page -- this is to prevent spambots from harvesting your address to send you mass unsolicited junk e-mail advertisements.

Ending Your Volunteer Role
You can cease volunteering with the Project upon the completion of any volunteer assignment, or when you are not currently engaged in an assignment. You may stay subscribed to the e-mail lists as long as you wish, regardless of your volunteering status with the Volunteering Project. Unsubscribing to the Project list, however, means you are no longer volunteering with our Project; if you unsubscribe, please send us an e-mail to let us know that you will no longer be volunteering with us and why.

Dismissal of a Volunteer
Volunteers who do not adhere to the rules and procedures of the agency or who fail to satisfactorily perform their volunteer assignment are subject to dismissal. No volunteer will be terminated until the volunteer has had an opportunity to discuss the reasons for possible dismissal with supervisory staff. Possible grounds for dismissal may include, but are not limited to, the following: gross misconduct or insubordination, theft of property or misuse of agency materials, abuse or mistreatment of clients, staff or other volunteers, failure to abide by agency policies and procedures, and failure to satisfactorily perform assigned duties.
